1. Overview

This website is operated by Essential Nerd ("we," "us," "our"). By visiting or purchasing from essentialnerd.com, you agree to be bound by these Terms of Service and any policies referenced here.

 

2. Business Details

Essential Nerd is owned and operated by Danillo Oscar (ABN 72600883393), Australia. Our site is hosted on Shopify Inc.

  • Our residential address is withheld from public listing for privacy/security; do not send returns to any address other than one confirmed via RMA.

 

3. Eligibility

You must be at least the age of majority in your state/territory to use this site. You may not use it for unlawful purposes or in violation of any applicable law, including copyright law.

 

4. Order Acceptance & Cancellation

  • Orders can be changed or cancelled only within 60 minutes of checkout — email info@essentialnerd.com. After that, orders are locked into fulfillment.
  • We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or excessive per-person/household quantities.

 

5. Shipping & Delivery

We currently ship to Australia and the United States only. See our Shipping Policy for processing times, delivery estimates, and delivery-finality terms (in short: once tracking shows delivered, our fulfillment obligation is complete).

 

6. Customs & Import Duties

Because our products ship from international fulfillment centers, you're the Importer of Record. Duties, taxes, and customs fees are your responsibility. Refusing to pay these fees may void your right to a refund of shipping costs.

 

7. Manufacturer Warranty

Our projectors carry a 12-month limited warranty provided by the manufacturer, covering manufacturing defects and hardware failure under normal use. See our Refund Policy for how to make a claim. This warranty doesn't replace or limit your non-excludable rights under the Australian Consumer Law.

 

8. Product Descriptions & Accuracy

We try to display accurate colors, specs, and images, but manufacturer data can vary from real-world results (screen glare, lighting, calibration, etc.). Minor variance isn't a defect under the Australian Consumer Law. Pricing and availability are subject to change without notice; we may correct errors even after an order is placed.

 

9. Prohibited Uses

You may not use this site to: break any law; infringe our IP or anyone else's; upload malicious code; submit false information; or otherwise interfere with the site's operation.

 

10. Limitation of Liability

To the maximum extent permitted by law, Essential Nerd is not liable for indirect, incidental, or consequential damages (lost profits, lost data, etc.) arising from use of the service or products purchased through it. This doesn't affect any consumer guarantee that can't be excluded under the ACL.

 

11. Dispute Resolution & Governing Law

These Terms are governed by the laws of New South Wales, Australia. Before filing a chargeback or dispute with your bank/PayPal, you agree to contact info@essentialnerd.com to try to resolve the issue directly. This document may be provided to payment processors as evidence of agreed terms.

 

12. Changes to These Terms

We may update these Terms at any time by posting changes here. Continued use of the site after changes means you accept the updated Terms.
